This is the sort of thing that Nick 'Mr Loophole' Freeman's firm would pounce all over to get some press. They aren't complete sharks - my mate used them for a speeding summons which he knew was on shaky ground and had the case thrown out of court using one of thier solicitors. Monkey Boy 1 Posted January 12, 2013 Author Report Share Posted January 12, 2013 Well, it has been a little quiet of late (No pun intended here) on the exhaust issue, that was until today. I received a court summons for 5th Feb 2013.to Gt.Yarmouth magistrates court under the charge "Use of motor vehicle with an altered silencer / Exhaust system" This freaked me out a little as I know the vehicle has an altered / non standard exhaust system which does emit a louder noise than a standard one (All modified exhausts do don't they ?) so I thought I was buggered. Anyway, on reading on with the reams of paperwork they have sent it seems that my initial complaint about how the test was conducted and the results interpreted have been overlooked. so I can still go down the road of the noise test being conducted incorrectly and not in accordance to ISO5130. Not ever having been through a court plea before, it's quite sneaky how they word things on the paperwork. Their "Statement of fact" says that " I was using my Toyota Celica with fitted with an exhaust system which had been altered so as to increase the noise made by the escape of exhaust gases". This is what rang alarm bells initially as I have already said, I knew that the exhaust is non standard and that it is louder than a OEM system. BUT the fact that the Police checked the noise not in accordance with ISO5130 is how I think I am going to play it. On the same technicality then you could also be caught out for using a cheap economy brand replacement mild steel system if it was producing too much noise. Limeymk1 Posted January 14, 2013 Report Share Posted January 14, 2013 Strictly speaking yes, you could have come out of Kwik Fit after having a replacement fitted and get pulled over and done if it was a tad louder than the one from Toyota. I'm not sure how they're going to deal with the GT86 as Toyota will fit the Milltek exhaust as an option as well as the TRD one. Both are louder than stock. Well that's how i'd read it but the revenue collectors - sorry let me rephrase that - traffic police may take whatever view their chief constables targets require then to take to meet said targets.
